We recall:

1. The written text is far more important than impressions from the drawings; drawings alone
in this type of patent cannot reveal the extent of claims.

2. Claims by SuperTurbine® may be untenable in some jurisdictions. Comparing claims from the written
text of potentially competing patents is usually a tough task, even for experts.  In some national jurisdictions,
a patent might be an instrument of commercial protection, while in another jurisdiction might not carry the same
the same property.

3. If one claim is found untenable or just an expression of prior art in the public domain, that does not mean
all the claims share the same fate.  We look for novelty.

4. Careful study of Selsam patents would be needed to carry out a comparison with this Makani patent.

I have for years read in the Selsam patent.
Upon reading the Makani patent, I felt strongly the Makani team was giving a book report about the Selsam patent.
I am struggling to find any clue that was not recited in the Selsam patent.  No novelty over Selsam is yet clear. 
Makani is invited to clearly point to one claim that is not already in Selsam patents.

Task yet is to prove novelty of Selsam patent claims.

Using a circular or closed loop path, rail, or track in wind power?  An ellipse, a squeezed closed path ... shape in closed looped is not a matter of perfect "circle" but of closed loop pathway. 
This topic thread is for patent claims and descriptions in wind power that describe the use of closed-loop pathways in the generation of power using the wind's kinetic energy.  Notes from researchers are welcome. 

Some notes: 
1. It will be found that closed loop pathways have been used in wind power schemes in old art. 
2. It is obvious that a closed loop pathway may be used in windpower. Go one way and keep going to get back to where one started. 
3. A back and forth crosswind track is also a closed loop scene. Just squeeze circle to the linear; go one way and stay on same path, but go the other way. 
4. Wings, sails, tethered wing ... wings around a closed loop. Obvious from prior art. 
5. Sailboats with sails and kite wings travel at will around closed loop pathways when they are so controlled and guided.  Obvious. 
6. Vanes going around a circle is perhaps the most common part of wind arts. Anyone skilled in wind energy, regardless of wing choice, is aware of using the circle as a path for generating electricity. 
7.  Notice how Darrieus and Savonius set with vertical axis are using a circular path that the wings follow. 
8.  Out and back is one of the oldest sailing, soaring, gliding tasks; triangle, circles, closed paths, same line out and back, etc. 
9.  The centuries old art of closed loop path for wind wings is available as obvious art when one flies the working wings even higher.

Gerald E. Steelman's Power Generating Device using fluid flows  where the draught kite has higher impact to flow than the return-profiled wing. This is echo of the Darrieus and Savonius principles: downwind capture while upwind profile is minimized (but still costing).  This is also echo in a type of laddermill, though of the type where the upwind low profile wing is not driving but only staying minimal drag (other laddermills may have driving downwind and driving upwind wings).

Careful claim study would be needed to look for novelty.
Closed-loop pathing and use of wind interacting with "sails" is a genre over a century old,
even in patent literature.  Many skilled in the arts see kite as sail: 

  US 5758911 by Heinz A. Gerhardt for Linear Motion Wind Driven Power Plant, filed in Feb. 7, 1996. 

Term: 20 years. What is novel in the claims? Sailing carts on track was well described before this patent,

Comment: Kushto seems to be teaching torqued "drive line" in the tether object.
And he uses multiple rotors in the lifter drive shaft.
The rotors rotate the shaft. The rotating shaft addresses loads at the ground.

  • Let the "length" of the blades be very long, that is, a blade that has a lower portion
    thin as tether and upper portion large as huge aerial kite wings. This seems to be in the
    spirit of the teaching, as the main focus is on the huge circular path-generator on the ground.
    This teaching seems to be predecessor for later explorers of carousels using long blades or kites.
